RESOUREX attaches great importance to compliance with antitrust regulations, including Art. 101 TFEU and the corresponding national regulations. Accordingly, RESOUREX does not tolerate any conduct on the platform that violates antitrust law. In connection with the use of the platform, the Users undertake to behave in a manner that complies with antitrust law.
Via RESOUREX, companies sell their products (mainly "coils") to buyers (B2B platform). RESOUREX itself does not act as a trader of the products sold via the platform. The participating companies undertake to refrain from all actions in connection with the use of the platform that could give rise to competition law concerns. In addition to agreements in violation of antitrust law, this includes, among other things, the exchange of competitively sensitive information, inter alia, on prices, pricing and other contractual terms; quantities sold / purchased or quotas; negotiation results / contract conclusions; production costs / input costs / cost structures; suppliers and customers; profit margins; tenders / offers or contract negotiations; strategies, product developments and investments. The platform was designed in such a way that suppliers and buyers do not have access to data that would allow them to draw conclusions about the behaviour of their competitors. Users of the platform are prompted by the system at the beginning of use to create a community consisting of a so-called "whitelist". Each User can create several "communities" with the respective targeted customers and edit these communities. Only one "community" can be selected per set order. Users of the platform are requested at the beginning of use not to include their own competitors in this "whitelist". Offers made by the User will not be shown to companies/competitors not included in the "whitelist". RESOUREX requires its Users, and the Users of the platform assure RESOUREX together with the conclusion of the terms of use, to truthfully identify their competitors and not to include them in the “whitelist“.
Furthermore, RESOUREX has designed the platform in such a way that Users are not shown concrete prices or availability outside their login area. In this context, it is pointed out that usually only minimum offers are displayed on the platform (exception: buy-it-now option). The closing price is only displayed to the respective contractual partner.
A breach of the obligation to behave in accordance with antitrust law in connection with the use of the platform shall lead to the immediate exclusion of the User from the use of the platform.
